Court Shrugs Off Appeal of Withdrawn Kentucky Ban on Gatherings

A ruling that blocked Kentucky Gov. Andy Beshear (D) from enforcing a broad order prohibiting in-person gatherings due to the coronavirus pandemic will continue, even though Beshear withdrew the order, the Sixth Circuit held Wednesday.

A federal district court blocked enforcement of the order pending the appeal, but “before that decision could be fully litigated before us, Governor Beshear withdrew the Order,” the U.S. Court of Appeals for the Sixth Circuit said. “That action renders this appeal moot, as we are without a live controversy to resolve.”
