Court Martial After State Court-Acquittal Denied SCOTUS Look

The Supreme Court declined to hear an appeal from a service member who was acquitted of murder in state court only to be tried, convicted, and sentenced to death years later by court martial for the same crime.

Rejecting review of Timothy Hennis’ appeal, the court will pass on scrutinizing what Hennis called the unprecedented government action against him.

The case is exceptional on several fronts, including for being the first time someone faces execution for charges of which a jury acquitted them, he said in his petition to the justices.
