Constitutional Labor Board Challenge Hits Supreme Court Snag (1)

An automotive fuel systems company fell short in its dash to the US Supreme Court in an effort to halt a National Labor Relations Board case while it challenges the agency’s constitutionality.

Justice Brent Kavanaugh denied Yapp USA Automotive Systems Inc.'s emergency petition Tuesday, which the company had filed at the high court just a day earlier.

Yapp asked for an order to freeze an unfair labor practice case alleging the company violated federal labor law in response to a union drive at its plant in Michigan. A hearing on that case was scheduled to begin Tuesday.
