Condo Association Avoids Unit Owner’s Retaliation Suit

A unit owner didn’t prove her retaliation suit against her condominium association, the U.S. Court of Appeals for the Seventh Circuit said May 25.

Sending fellow owners updates about the status of the owner’s Fair Housing Act suit against the association was reasonable, the opinion by Judge William J. Bauer said.

After an incident in her building’s elevator, Holly Geraci was diagnosed with post-traumatic stress disorder. She sued the Union Square Condominium Association for not accommodating her disability and added the retaliation claim.
