Colorado Top Court Clarifies Venue for Lawsuits Involving LLCs

Two lawsuits against a health-care limited liability company must be brought in the county where it operates, Colorado’s top court said, clearing up a question of first impression in the state.

For purposes of determining venue under Colorado’s procedural rules, an LLC’s residence is that of the company itself, not that of its individual members, a unanimous Colorado Supreme Court said in a pair of cases.

Floyd Nelson sued Encompass PAHS Rehabilitation Hospital LLC for negligence, medical negligence, and negligent hiring, supervision, and retention. He sought damages for injuries he suffered in a fall while a patient at the facility. ...
