Class Action Over Staples Service Plan Reinstated

Proposed class claims by New York consumers have been reinstated against Staples, Inc. in a suit alleging the retailer breached its repair-or-replace contract for computers and engaged in a deceptive practice (Orlander v. Staples, Inc., 2015 BL 298925, 2d Cir., 14-2677-cv, 9/16/15).

The fine print on the back of the Staples two-year Carry-In Protection Plan “could mean several things,” including alternative protection alongside the manufacturer’s one-year warranty on plaintiff Andrew Orlander’s Hewlett Packard computer, the U.S. Court of Appeals for the Second Circuit said Sept. 16.
