City’s Nipple Ban Survives Challenge from ‘Bikini Baristas’

A Washington city’s law barring the exposure of too much skin survived a constitutional challenge on Wednesday, although a second dress-code law for workers at quick-service facilities was struck down as discriminatory against women.

The surviving Everett, Wash., law criminalized “lewd conduct"—defined as exposure of a female nipple or lower breast and anyone’s genitals or anus. The law that was struck down required employees at facilities like coffee stands and fast-food restaurant to wear clothing covering their chests, stomachs, butts, private parts, and specified portions of their legs and backs.
