Issue:

May a former prisoner, who is no longer in custody, bring a civil rights action establishing the unconstitutionality of their conviction without showing a favorable termination of their claim? The en banc Fifth Circuit agrees with the First, Third, and Eighth circuits, saying that they can’t. The Second, Fourth, Sixth, Ninth, and Eleventh circuits say that they can.
