Issue:

Is there a prevailing-party requirement to recover litigation costs under Federal Rule of Civil Procedure 54? The Eleventh Circuit joins the Second, Fifth, and Eighth circuits, saying there can be cases in which neither party prevails. But the Federal Circuit says that a court must always declare a prevailing party.
