Ciox Health Defeats Class Appeal in Medical Records Request Suit

Ciox Health LLC prevailed in an appeal from the dismissal of a proposed class action alleging it charges too much for fulfilling electronic medical records requests because Montana law doesn’t limit the fees in all circumstances, the Ninth Circuit said.

A Montana law stating that companies may charge a “reasonable” fee applies when requests are made to health-care providers that aren’t regulated by the federal Health Insurance Portability and Accountability Act, the U.S. Court of Appeals for the Ninth Circuit said in an unpublished opinion.
