Christian Adoption Agency’s Suit Over Same-Sex Couples Revived

A New York adoption agency professing Christian religious beliefs stated valid claims for free exercise of religion and free speech over a state mandate to accept same-sex and unmarried couples as prospective adoptive parents or close down, the Second Circuit said in a reversal Tuesday.

New Hope Family Services Inc.'s complaint “easily” gave rise to the slight suspicion of religious animosity necessary for a free-exercise claim at an early stage of the suit, the appeals court said.
