Challenges to ICE’s Courthouse-Arrests Policy May Proceed (1)

A U.S. Immigration and Customs Enforcement policy that allows agents to round up, at state courthouses, any immigrants they suspect of being in the country illegally will continue to be subject of claims that it violates New York common law and the U.S. Constitution, a federal court said.

The policy applies to both civil and criminal cases and reaches family members and others who accompany a party attending a proceeding, Judge Alison J.
