Arbitrator Paul D. Roose found that E&J Gallo Winery did violate its collective bargaining agreement with the UFCW when it placed eight of its mechanics from one line on the combined departmental seniority list based on their plant seniority date. While the CBA allowed the winery to combine the two bottling lines at issue as it saw fit, it failed to account for certain experience for these eight mechanics when combining the seniority lists from each line.
