A Virginia circuit court in Fairfax County granted a plea in bar to mortgage professionals and support staff defendants against Intercoastal Mortgage LLC’s claims for injunctive and other relief based on alleged violations of non-solicitation provisions in their employment agreements, finding that the provisions were unenforceable as a matter of law because they were overbroad, lacked temporal and geographic limitations, were unduly burdensome on the employees’ ability to earn a living, and were against public policy by restricting customer choice.
