California Wins Suit to Clear Out Homeless Camps Near Highways

The California Department of Transportation can clear out homeless encampments in dangerous road areas, the Ninth Circuit said, vacating a six-month injunction issued under a federal discrimination law to give campers with mental illness time to relocate.

The injunction preventing the camps in Emeryville, Calif., from being closed for six months isn’t supported by the Americans with Disabilities Act, and the U.S. District Court for the Northern District of California improperly balanced the equities, the opinion by Judge Ryan D. Nelson said.
