The California Trucking Association asked a federal judge to issue a new injunction preventing enforcement of a state independent contractor law while a court challenge proceeds.
The industry group said it will likely prevail on the merits in its action arguing that the Federal Aviation Administration Authorization Act preempts California’s ABC test for evaluating whether a worker is an employee or independent contractor. Enforcing the law for truck drivers in the meantime would cause irreparable harm, according to the renewed preliminary injunction bid filed in the US District Court for the Southern District of California.
