California Lawyer Gets New Chance to Show Bar Exam Violated ADA

A California attorney’s claim that the State Bar of California’s refusal to accommodate him while taking the bar exam violated federal discrimination law must be sent back to a federal trial court, the Ninth Circuit said Monday.

Though the state bar is an arm of the state and Title II of the Americans with Disabilities Act abrogated the state’s 11th Amendment immunity, the district court didn’t properly apply the applicable analysis to the case, Judge Kim McLane Wardlaw said for the US Court of Appeals for the Ninth Circuit.
