California High Court Rejects Arbitrating Group PAGA Claims (1)

California employers can’t force individuals to arbitrate claims brought on behalf of other workers under a unique law that allows employees to step into the state’s shoes and sue for labor violations, a unanimous state supreme court ruled Monday.

Justices rejected Uber Technologies Inc.'s arguments that employees who sign arbitration agreements when they sign up to work for the service lose their standing to represent others when their own labor law claims under the Private Attorneys General Act, filed on the state’s behalf, are ordered to arbitration.
