Bureau of Prisons Avoids Suit Over Inmate Prerelease Moves (1)

A class action challenging when the Federal Bureau of Prisons transfers inmates to prerelease custody under the First Step Act was dismissed by a federal court.

The individual claims are now moot and a provisional class can’t be certified for their claim seeking to compel agency action, Judge Amit P. Mehta said Monday for the US District Court for the District of Columbia. But the plaintiffs’ allegation that a BOP regulation dealing with FSA time credits is contrary to law, was dismissed for failure to state a claim.
