Boneless Wing Eaters Should Expect Bones, Ohio High Court Says

The Ohio Supreme Court on Thursday said in a sharply-divided decision that diners eating boneless chicken wings can reasonably expect to encounter bones and guard against swallowing one.

The justices reaffirmed a test laid out by the court more than 60 years ago, which said a supplier’s possible liability for breaching its duty of care by not removing an “injurious substance” from food depends on whether the consumer could’ve reasonably expected and guarded against the substance. Whether the substance is foreign or natural to the food is also relevant, Justice Joseph T. Deters (R) wrote for the majority.
