Boeing Can Defend Asbestos Exposure Suit in Federal Court

Boeing Co. will get to defend itself in federal court against a woman’s claim that she was exposed to asbestos and developed cancer because her father and husband worked for the company, the Ninth Circuit said.

Connie Dietrich said that her suit had to stay in state court because Boeing missed the deadline for removing it to federal court. Boeing had sufficient facts allegedly establishing federal jurisdiction before the 30-day limitations period for seeking removal passed, she said.

Although the district court agreed with Dietrich, the U.S. Court of Appeals for the Ninth Circuit said Boeing’s removal request was timely. ...
