Boca Raton Real Estate Broker Saves Registered Trademark

A federal district court erred when it canceled a Boca Raton, Fla., real estate broker’s registered trademark for “Royal Palm Properties,” the Eleventh Circuit said.

A competitor, Pink Palm Properties, didn’t rebut the presumption that registered trademarks are valid, the opinion by Judge Kevin C. Newsom of the U.S. Court of Appeals for the Eleventh Circuit said.

Royal Palm Properties operates exclusively in Boca Raton’s high-end community, Royal Palm Yacht & Country Club. When Pink Palm used “Royal Palm Properties” as a link on its website, Royal Palm sued for infringement.
