An injunction barring the City of Everett, Wash., from enforcing ordinances requiring that “bikini baristas” cover their body parts was tossed by the Ninth Circuit July 3.
The baristas aren’t entitled to an injunction because they aren’t likely to succeed on the merits of their claims, the U.S. Court of Appeals for the Ninth Circuit said.
The city may therefore enforce its Dress Code Ordinance and amendments to its Lewd Conduct Ordinances while the case proceeds, the court said.
The baristas argue that the amendments are unconstitutionally vague and violate their free expression in violation of the First Amendment.
