A suit by Texas and Missouri seeking to have the US Department of Homeland Security spend the $2.75 billion Congress allocated to build a wall on the US’s southwest border was improperly dismissed, a federal appellate court said.
The Biden Administration diverted the funds to other projects and the two states sued, but a federal trial court dismissed Texas for claim splitting and Missouri for lack of standing. Because Texas didn’t split its claims and had standing, the suit may proceed, the opinion by Judge Edith H. Jones said for the US Court of Appeals for the Fifth Circuit.
