An Education Department rule to apply sex-based discrimination protections to transgender students would be blocked through the Congressional Review Act under H. J. Res. 165.

The rule, which was published on April 29 and goes into effect Aug. 1, expands the Title IX prohibition on sex-based discrimination in education programs that receive federal financial assistance to include gender identity, sexual orientation, and sex characteristics.

The rule also clarifies the prohibition on sex-based discrimination includes sex-based harassment, including hostile environment harassment.
