Battle Over NY Chief Judge Heads to Court, Republican Files Suit

A Republican New York state senator is suing members of his chamber’s Democratic majority for rejecting Gov. Kathy Hochul’s nominee to become the state’s top judge without bringing the matter before the full Senate for a vote.

The lawsuit, filed Thursday in state Supreme Court in Suffolk County, aims to break the current stalemate between the Democratic governor and state Senate. The Senate Judiciary Committee in January denied the elevation of Hochul nominee Hector D. LaSalle to chief judge on the Court of Appeals. He is currently presiding justice of the Appellate Division of the Second Judicial Department.
