A Georgia-Pacific LLC subsidiary created to address the manufacturer’s legacy asbestos liabilities won an appeal to subpoena data on asbestos exposure claims from several settlement trusts.
The Wednesday ruling by the US Court of Appeals for the Third Circuit advances a bid by the subsidiary, Bestwall LLC, to test a theory that victims are trying to collect more than they’re owed.
Bestwall, which filed for bankruptcy shortly after being created to absorb Georgia-Pacific’s mass tort legal liability, is trying to collect sensitive asbestos claims data from victims trusts.
