The fraud conspiracy convictions of two Bank of Oswego officers must be vacated because the prosecution used legally insufficient theories to present its case, a divided Ninth Circuit said Friday.
Dan Heine and Diana Yates were accused of altering the bank’s books to make them more acceptable to Federal Deposit Insurance Corporation inspectors.
Heine and Yates were charged with conspiring to defraud the bank, which required deceiving the bank of something of value. The prosecutor told the jury that they deprived the bank of accurate information in its books, their salaries and bonuses, and the use of bank funds.
