A class of iced tea drinkers who say Arizona Beverages USA LLC misled them about the presence of preservatives in some drinks doesn’t have standing to seek injunctive relief, but can proceed with other state law claims, a federal judge in New York decided.
The suit alleges Arizona fools consumers by touting numerous iced teas as having “no preservatives.” More than a dozen flavors contain citric acid, a common preservative added to foods and beverages to prevent the growth of bacteria, the class said.
