A Ninth Circuit ruling reopened the door for two Apple users to bring a privacy suit against the technology giant for hosting a fraudulent cryptocurrency wallet in its app store.
A three-judge panel of the US Court of Appeals for the Ninth Circuit affirmed a California federal court’s dismissal of several claims, citing publishing immunity granted to online platforms under Section 230 of the Communications Decency Act, but found the liability shield doesn’t apply to Apple’s representations in authorizing the bogus app.
