Apple Fails to Fast Track Appeal of ITC’s Smart Watch Trade Ban

Apple Inc.'s bid to to expedite its appeal of a US International Trade Commission ban of Apple Watches with blood-oxygen measuring functionality was denied by the Federal Circuit.

The court, which has exclusive jurisdiction over patent appeals, on Tuesday rejected Apple’s motion to expedite the date of oral argument in the case. The tech giant’s motion was opposed by both the ITC and Masimo Corp., a medical device company that convinced the trade agency last year that Apple infringed claims from two of its blood-oxygen sensor patents.
