Appeals Court Backs Officer in Deadly Force Case Using New Test

A Texas police officer who shot and killed a driver of a car trying to flee from a traffic stop didn’t violate the driver’s civil rights, the Fifth Circuit said.

Looking at the totality of the circumstances, Deputy Roberto Felix acted reasonably when he fatally shot Ashtian Barnes on the Sam Houston Tollway in Houston, Judge Patrick E. Higginbotham wrote Thursday for the US Court of Appeals for the Fifth Circuit.
