Two former Capital One Services LLC employees who say severance pacts they signed when they left the company didn’t waive their rights to sue as a class for age bias or unpaid overtime wages failed to support their renewed bid to fast track the issue to the Fourth Circuit, the Eastern District of Virginia ruled.
