AmerisourceBergen Board Loses Opioid Defense After Novel Ruling

AmerisourceBergen Corp.'s senior leaders lost their bid to end investor litigation over its role in the opioid epidemic, when a Delaware judge held in a novel decision Thursday that the pension funds leading the lawsuit filed it on time.

Vice Chancellor J. Travis Laster issued a first-of-its-kind ruling against members of the board and management at AmerisourceBergen, which agreed in 2021 to pay $6 billion to resolve claims by states and local governments that accused the company of fueling the nationwide crisis. The drug distributor has also spent more than $1 billion on its legal defense.
