Amazon Didn’t Waive Trump Bias Claim in $10B JEDI Contract Case

Microsoft Corp. and the Justice Department were unable to show Amazon waived its bias claim that former President Donald Trump improperly used political pressure to influence the award of the $10 billion JEDI cloud contract, the U.S. Court of Federal Claims said.

The government said Amazon waived the argument in its bid protest by not raising it before the first Microsoft award in October 2019. Microsoft and the government together claimed Amazon waived the claim by not challenging the Department of Defense’s re-evaluation process before selecting Microsoft a second time in September 2020.
