Alaska Workers’ Compensation Commission Can Grant Enhanced Fees

The Alaska Workers’ Compensation Act authorizes the Alaska Workers’ Compensation Appeals Commission to award enhanced attorney’s fees to successful claimants, the state’s high court held Friday.

Sandra Rusch and Brenda Dockter participated in separate workers’ compensation proceedings against the same employer, the Southeast Alaska Regional Health Consortium. The parties settled most issues, but the claimants appealed after not receiving their expected attorney fees for Franich Law Office LLC, which represented Rusch and Dockter in the proceedings.
