Alabama Attorney General Avoids Suit Over Gambling Investigation

Alabama Attorney General Steve Marshall is immune from a suit claiming he unconstitutionally seized $224,500 during an investigation into illegal gambling, the Eleventh Circuit said Tuesday.

Although a related state suit was pending, the unpublished per curiam opinion by the US Court of Appeals for the Eleventh Circuit made clear it didn’t have to abstain from hearing the federal claims. The federal suit won’t interfere with the Alabama suit, and the state court isn’t an adequate forum for Bruce Pettway to pursue his constitutional claims, the court said.
