The conviction of Abid Naseer for providing material support to al-Qaeda was upheld by the Second Circuit Aug. 20.
Naseer knowingly waived his right to counsel, the summary order said. The record “amply establishes” that he had the to capacity to make an intelligent decision, the district judge explained the risks of self-representation, and he was repeatedly told he could change his mind, it said.
Naseer’s evidentiary challenges were also rejected. The challenged evidence helped establish the existence of terrorist conspiracy and provided necessary background to understand the communications between Naseer and al-Qaeda, the court said.
