Adult Novelty Store Loses Fight Against Atlanta Zoning Code

The operators of an adult novelty and video store known as Tokyo Valentino lost their challenge to an Atlanta law limiting the location of “adult businesses” because the law doesn’t substantially restrict more speech than necessary, the Eleventh Circuit said.

The city zoning scheme’s definitions of “adult bookstore,” “adult motion picture theater,” “adult mini-motion picture theater,” “adult cabaret,” and “adult entertainment establishment” aren’t facially overbroad in violation of the First Amendment, the U.S. Court of Appeals for the Eleventh Circuit said.
