A federal judiciary advisory committee will weigh a change to the rule governing administrative stays, after several members of the US Supreme Court raised the issue in a decision earlier this year.
The Advisory Committee on Appellate Rules on Wednesday created a subcommittee to look into the issue, at the urging of Will Havemann, an attorney with Hogan Lovells. Administrative stays are typically used to allow the “status quo” to remain in place while a law, policy, or regulation is being litigated.
