Access, Copyright Fight Over Safety Standard Jumps to D.C. Cir.

A consumer can’t pursue free access to the full content of safety regulations that incorporate industry standards at the Third Circuit because federal law gives another court jurisdiction, the appeals court said.

Lisa Milice’s challenge, which raises issues of constitutional, intellectual property, and administrative law and could affect the widespread government practice of adopting private standards, will be transferred to the U.S. Court of Appeals for the D.C. Circuit.
