3M Can Resume Arguing Certain Combat Earplug Issues for Now

3M Co. can try to argue issues in bankruptcy court that were already decided by a federal judge handling personal injury litigation over allegedly defective combat earplugs, at least while an appeal proceeds, the Eleventh Circuit ruled.

Judge M. Casey Rodgers, who oversees the vast multidistrict litigation in federal court in Florida, had prohibited 3M from asking the bankruptcy court to revisit her rulings.

But the US Court of Appeals for the Third Circuit granted 3M’s request for a stay of Rodgers’ order Wednesday, without comment.
