Website Liability Law Dodges Constitutional Challenge (1)

A website liability law aimed at combating sex trafficking has escaped a constitutional challenge.

The U.S. District Court for the District of Columbia Sept. 24 dismissed First Amendment claims over the law, which holds websites liable for intentionally promoting prostitution and knowingly facilitating sex trafficking.

The plaintiffs lack standing to sue because they failed to show the law harmed them, Judge Richard J. Leon said. They face no credible threat of prosecution because they haven’t claimed that they intend to promote prostitution, the court said.
