Taxicab operators survived dismissal of an amended complaint in the U.S. District Court for the District of Massachusetts that Uber Technologies Inc. competes unfairly because it is not required to comply with Boston’s taxi regulations (Boston Cab Dispatch, Inc. v. Uber Technologies, Inc., 2015 BL 17660, D. Mass., 1:13-cv-10769-NMG, 1/26/15).
Judge Nathaniel M. Gorton held that the taxicab operators had sufficiently alleged in their amended complaint that Uber’s conduct in the market proximately caused them injury in the form of lost revenues. As such, he declined to dismiss their state and common law unfair competition law claims. ...
