Tesla Privacy Lawsuit Belongs in State Court, Plaintiff Argues

A privacy and product safety lawsuit against Tesla Inc. should be sent back to Hawaii state court because the car company doesn’t have the right to remove under class action law, the plaintiff argued.

Tesla has “fully failed” to show how the case’s removal to federal court is appropriate under the Class Action Fairness Act, plaintiff Jerry Hiatt argued in a reply memorandum filed June 18 in the U.S. District Court for the District of Hawaii.

Attorneys representing Tesla didn’t immediately respond to a request for comment.
