TDK, Others Must Defend Disk Drive Component Price Fixing Claims

TDK Corp., NHK Spring Co. and other electronics manufacturers failed to shake off as untimely Flextronics International USA Inc.'s claim that they conspired to inflate the price of hard disk drive suspension assemblies, a critical computer component.

The complaint alleges the defendants entered into a conspiracy to “fix, raise, stabilize, and maintain prices of, and allocate market share for, hard disk drive suspension assemblies” from “at least” 2003 through April 2016. The manufacturers moved to dismiss the claims, filed under California and Tennessee law, saying they are barred by the applicable state statutes of limitations.
