TCPA Litigation Booming as FCC Rolls Out New Telemarketing Rules

Attorneys debated whether the Federal Communications Commission’s updated telemarketing rules will increase the already growing number of Telephone Consumer Protection Act (TCPA) lawsuits, in interviews Oct 16.

On Feb. 15, 2012 the FCC approved an order that created additional protections for consumers who seek to avoid unwanted telemarketing calls and text messages. The new rules, which went into effect Oct. 16, come at a time when TCPA lawsuits are on the rise, according to recent litigation data.

The law now requires telemarketers to obtain clear and conspicuous written consent from consumers before they send autodialed telemarketing calls and text messages. ...
