Supreme Court Sends Junk-Fax Case Back to Fourth Circuit (1)

The U.S. Supreme Court punted on the question of whether district courts can independently interpret the federal robocall law or must defer to the Federal Communications Commission’s reading.

The extent to which a court is bound by the FCC’s interpretation depends on the legal nature of the agency’s order and whether a defendant had a chance to seek judicial review of the order, the justices ruled.
