Sirius XM Radio Inc. beat a remanded patent suit over its high-band satellite radio system after a federal judge ruled a German research group’s years-long silence sank its infringement claims.

Sirius relied on Fraunhofer-Gesellschaft zur Förderung der angewandten Forschung e.V.’s more than five-year silence in deciding to adopt the accused system, Judge Joseph F. Bataillon said in an opinion issued Tuesday in the US District Court for the District of Delaware.
