A software company escaped a lawsuit alleging it infringed a patented system for developing simulation models.
The U.S. District Court for the District of Utah June 20 dismissed Simio LLC’s complaint that FlexSim Software Products Inc. infringed Patent No. 8,156,468, on the grounds that the patent claims at issue aren’t protected under federal law.
Section 101 of federal patent law allows patents for new and useful processes, machines, manufactures, or compositions of matter. Simio had argued that the patent claims qualify for protection as a machine.
